McNabb, Inc., a Delaware corporation doing business as ScreenMate ("ScreenMate," "we," "us," or "our"), operates a background check management platform at screenmateco.com and associated subdomains (the "Platform"). This Privacy Policy describes how we collect, use, disclose, and protect personal information when you interact with our Platform.
This Privacy Policy applies to all individuals who interact with the Platform, including:
- Companies and Employers who use the Platform to request background checks;
- Investigators who conduct background investigations through the Platform;
- Candidates who are the subjects of background checks and submit personal information through our intake forms; and
- Website Visitors who browse our public website.
1. Information We Collect
We collect different types of information depending on how you interact with the Platform.
1.1 Information from Candidates
When a Company requests a background check on you and you complete our intake form, we collect:
Highly Sensitive Personal Information:
- Social Security Number
- Date of birth
- Driver's license number and state
- Current and previous residential addresses
Other Personal Information:
- Full legal name, including previous names, maiden names, and aliases
- Email address and phone number
- Employment history and references
- Educational background
- Character references
Consent and Authorization Records:
- Electronic signature
- Date and time of consent
- Technical information about your submission
For Minor Candidates (Under 18): If you are under 18, we also collect your parent or guardian's name, relationship to you, and electronic signature authorizing the background check.
1.2 Information from Companies and Investigators
When Companies or Investigators register for accounts, we collect:
- Business name and contact information
- Account holder name and email address
- Phone number and business address
- Account credentials (stored in encrypted form)
- For Investigators: Professional license information and payment account details
1.3 Information Collected Automatically
When you access the Platform, we automatically collect certain technical information, including:
- Device and browser information
- Pages visited and features used
- Date and time of access
- Network and connection information
1.4 Background Check Results
Investigators upload background check reports to the Platform, which may contain information about a Candidate's criminal history, motor vehicle records, credit history (where authorized), employment verification, education verification, and other findings. ScreenMate stores these reports on behalf of Companies and Investigators but does not generate or verify the content of these reports.
2. How We Use Your Information
2.1 For Candidates
We use Candidate information to:
- Facilitate the background check process requested by the Company
- Provide your information to the assigned Investigator to conduct the background check
- Document your consent and authorization for compliance purposes
- Send you confirmation communications regarding your submission
- Maintain records as required by law
2.2 For Companies and Investigators
We use Company and Investigator information to:
- Create and manage user accounts
- Provide access to Platform features and services
- Process payments and manage billing
- Verify Investigator credentials
- Send service-related communications
- Enforce our Terms of Service and protect against fraud
- Comply with tax reporting requirements
2.3 For All Users
We may also use information to:
- Maintain Platform security and prevent unauthorized access
- Monitor and analyze usage patterns to improve the Platform
- Comply with legal obligations and respond to lawful requests
- Create anonymized, aggregated data for analytics (which cannot be used to identify individuals)
3. How We Share Your Information
We do not sell your personal information. We share information only in the following circumstances:
3.1 Within the Background Check Process
- Candidate Information to Investigators: When a Company requests a background check, we share Candidate information with the assigned Investigator so they can conduct the investigation. This is the core purpose of the Platform.
- Reports to Companies: Investigators upload completed background check reports, which are made available to the Company that requested the check.
- Limited Company Information to Candidates: We share the Company's name with Candidates so they know who is requesting the background check.
3.2 Service Providers
We engage third-party service providers to help us operate the Platform, including providers of cloud hosting, payment processing, and email delivery services. These providers access personal information only as necessary to perform services on our behalf and are contractually obligated to protect your information and use it only for the purposes we specify. We do not share Candidate Social Security Numbers, dates of birth, or background check results with payment or email service providers.
3.3 Legal Requirements
We may disclose personal information if required to do so by law or in response to valid legal process, including subpoenas, court orders, or government requests. We may also disclose information to protect the rights, property, or safety of ScreenMate, our users, or others.
3.4 Business Transfers
If ScreenMate is involved in a merger, acquisition, or sale of assets, personal information may be transferred as part of that transaction. We will notify affected users of any change in ownership or control of their personal information.
4. Data Retention
We retain personal information only for as long as necessary to fulfill the purposes described in this Privacy Policy, comply with our legal obligations, resolve disputes, and enforce our agreements.
For Candidates:
- Completed Background Checks: Your personal information and the associated report are retained in accordance with applicable legal requirements and industry best practices, after which your information is securely deleted or anonymized.
- Incomplete or Abandoned Requests: If you submit your information but the background check is not completed, your personal information is automatically deleted after a short period.
- Intake Links: The secure link sent to you expires after a limited time and can only be used once.
- Certain Demographic Data: Some demographic information is deleted promptly upon completion of the background check to minimize data exposure.
For Companies and Investigators:
- Account information is retained for as long as your account is active and for a reasonable period thereafter to comply with legal obligations, resolve disputes, and enforce agreements.
- Payment records are retained as required for tax and audit purposes.
5. Data Security
We implement industry-standard administrative, technical, and physical safeguards designed to protect your personal information from unauthorized access, use, alteration, and disclosure. These measures include:
- Encryption: Personal information is encrypted both when stored in our systems and when transmitted over the internet.
- Access Controls: We restrict access to personal information to authorized personnel who need it to perform their job functions. Candidate information is only accessible to parties directly involved in the specific background check.
- Monitoring: We monitor our systems for potential security incidents and unauthorized access.
- Authentication: User accounts are protected by secure authentication mechanisms.
- Secure Document Access: Background check reports require authentication to access and cannot be retrieved through shareable links.
While we strive to protect your personal information, no method of transmission over the Internet or electronic storage is completely secure. We cannot guarantee absolute security, but we are committed to promptly addressing any security incidents in accordance with applicable law.
6. Your Rights and Choices
6.1 Rights for All Users
Depending on your location, you may have certain rights regarding your personal information:
- Access: You may request information about the personal data we hold about you.
- Correction: You may request that we correct inaccurate personal information.
- Deletion: You may request that we delete your personal information, subject to legal retention requirements.
- Portability: You may request a copy of your personal information in a structured, commonly used format.
6.2 Specific Rights for Candidates
As the subject of a background check, you have additional rights under the Fair Credit Reporting Act (FCRA):
- Right to a Copy of Your Report: You may request a copy of any consumer report from the Investigator who prepared it.
- Right to Dispute Inaccurate Information: If you believe information in your report is inaccurate, you may dispute it directly with the Investigator, who must reinvestigate within the timeframe required by law.
- Right to Know Before Adverse Action: If a Company intends to take adverse action (such as denying employment) based on your background check, they must provide you with a copy of the report and a summary of your rights before doing so.
- Summary of Rights: You are entitled to a "Summary of Your Rights Under the Fair Credit Reporting Act," which the Company must provide.
Important: Because ScreenMate is a technology platform and not a Consumer Reporting Agency, requests for copies of reports or disputes about report accuracy should be directed to the Investigator who conducted the background check or the Company that requested it. We can help you identify the appropriate contact.
6.3 How to Exercise Your Rights
To exercise any of these rights, please contact us using the information in Section 11. We will respond to your request within the timeframes required by applicable law. We may need to verify your identity before processing your request.
7. California Privacy Rights
If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA). However, please note that much of the information processed through the Platform may be exempt from CCPA/CPRA because it is covered by the Fair Credit Reporting Act.
To the extent CCPA/CPRA applies, California residents have the right to:
- Know what personal information we collect, use, and disclose
- Delete personal information (subject to exceptions)
- Correct inaccurate personal information
- Opt out of the sale or sharing of personal information (we do not sell personal information)
- Non-discrimination for exercising your privacy rights
California residents may designate an authorized agent to make requests on their behalf. We may require verification of the agent's authority.
8. Other State Privacy Rights
Residents of other states with comprehensive privacy laws may have similar rights to access, correct, delete, and obtain a copy of their personal information. We will honor valid requests in accordance with applicable state law. To exercise your rights, please contact us using the information in Section 11.
9. Children's Privacy
The Platform is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete that information promptly.
For background checks on minors, we require parental or guardian consent as described in Section 1.1.
10. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. We will post any changes on this page with an updated "Last Updated" date. For material changes, we will provide notice through email or a prominent notice on the Platform before the changes take effect. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Privacy Policy.
